If the trademark objection is not filed within the specified and reasonable time, then there is an option with the TM examiner to mark that Trademark application as Abandoned.

The difference between listed company and public company is very simple. A public company when go to public to raise capital, it had to get registered with stock exchange and once it is registered, then it is also known as listed company.

Q. How to Select Name for Limited Liability Partnerships (LLP)? with examples.

The LLP name selection process is very similar to that of company. The LLP name should start with your brand name e.g Hubco is our brand name (Trademark filed) and hence we have registered Hubco Technologies LLP. The second part of the LLP name denotes its objective. Like in case of Hubco Technologies LLP, technology denotes its technology business. The last part of the Company name ends up with the letters LLP. No LLP can be registered without having LLP at the end. Important Point: The new LLP name should not match the existing company/LLP name or any existing trademark in India.

After filling the TM-12 i.e replying the TM objection raised by the trademark examiner it will take 30 to 60 days to change the status of the trademark application.

The LLP name check can be done at mca.gov.in. Mca.gov.in keeps the record for every company /LLP incorporated till date and hence it helps you search your name and chances of approval with Registrar of Companies.

Once you saw that your trademark application status on IpIndia website is showing objected, then you need to go through the trademark examination report which you might received or you can dig out the same from IpIndia website.

The TM Applicant needs to respond back the Trademark examination report within 30 days of the receipt of the report.When the applicant receives the Trademark examination report by personal or via his attorney then reply needs to filed within the 30 days mandatorily.
